He was also a member of the Ohio State Senate and the Ohio House of Representatives and served as a surrogate delegate to Congress for four years. Known as "Judge" to his friends, he wrote over 40 books on law, philosophy, art, and education during his long lifetime. His best-known works include The Law That Never Was (1899), The New Constitution (1914), What's the Right Thing To Do? (1908), and The Case for Christ (1933).

Judge Marshall died in 1948 at the age of 88.
